Property search in Portugal: records, tax and buying checks

Search Portuguese homes by municipality and property type, then reconcile the land certificate, tax record, licensing, condominium and closing evidence.

A Portuguese property search becomes reliable only when the advertisement, permanent land-registry certificate, tax record, municipal licensing and physical building describe the same asset. Reconcile them before a reservation or promissory contract.

1. Search by concelho, freguesia and Portuguese property type

Location labels can be broad and rural pins imprecise. Search from municipality to parish, then verify coordinates, access and services. Separate apartment, moradia, terreno and rural mixed-property searches because their evidence differs.

  • Use “apartamento à venda”, “moradia”, “terreno urbano” or “quinta” with the concelho/freguesia and intended use.
  • Add condomínio, licença de utilização, certificado energético, para recuperar and vista mar only as questions to verify.
  • For rural/coastal homes, record access, water, wastewater, boundaries, fire exposure, works history and year-round services.

2. Match legal, tax and physical descriptions

Portugal uses related identifiers across registry, tax and municipal systems. Preserve each identifier and flag inconsistent areas, fractions, outbuildings or uses for professional resolution.

  • Registry: Obtain a current certidão permanente showing ownership, composition, charges and pending registrations.
  • Tax: Compare the caderneta predial’s article, fraction, VPT and description with the certificate and marketed property.
  • Municipality: Verify use licence or dispensation, plans, permits and lawful status of additions, pools and converted space.
  • Condominium: For apartments, request rules, minutes, accounts, insurance, arrears statement, reserve and approved works.

3. Use the certidão predial as a live legal-status check

Portugal’s Justice portal says the land register provides the legal situation of buildings and land, including composition, ownership and charges. The permanent certificate also exposes pending registration requests while valid.

  • Ownership and charges: Match owners, description, fraction, mortgages, seizures, usufruct or other burdens to the parties and release mechanics.
  • Pending entries: Treat a pending registration as a transaction question requiring explanation before a deposit or completion date.
  • Boundaries: For land, reconcile identifiers, BUPi/cadastral material where applicable, survey evidence and occupation on site.
  • Preference rights: Ask the conveyancer whether any public or private pre-emption process applies.

Save the property identifier, search date, document version and any mismatch between the official material and the advertisement. A register extract is an input to property-specific professional review, not a guarantee about physical condition or every unrecorded fact.

4. Make the CPCV reflect unresolved checks

A contrato-promessa de compra e venda can create substantial obligations and is commonly paired with a sinal. Identify the property, price, deposit character, finance, legalisation tasks, completion deadline, vacant possession and default consequences.

  • Conditions: Write the finance, title, licensing, survey, condominium and buyer-document conditions that must be satisfied.
  • Deposit: Verify recipient and account independently, state what the payment represents and preserve the authenticated trail.
  • Completion documents: List certificate, tax record, energy certificate, use evidence, condominium declarations and identity/tax-number requirements.

5. Calculate tax before the deed and register immediately

The Tax Authority says IMT and stamp-duty evidence or exemption must be available for the deed and generally uses the higher of purchase value and VPT. Casa Pronta can combine contracts, tax and registration for eligible cases.

  • Tax: Calculate current IMT and stamp duty from buyer status, property nature, use and taxable value; do not reuse a portal estimate.
  • Deed: Reconcile parties, fraction/land, price, payments, burdens, licence evidence and possession before authentication.
  • After closing: Confirm land registration and tax-record updates, then retain the deed, certificates, tax receipts and handover record.
